Terms and Conditions


Make sure that your passport is valid for international travel, and that it will be valid for six months after you return to your home country. It is the passenger's duty to ensure that all visas are obtained timeously.

Ngwe Safari will not be held responsible for incorrect visas.

Insurance

It is strongly advised that you take out adequate insurance cover in the event of cancellation due to accident, illness or injury. Personal liability and personal accident are also recommended. Ngwe Safari will not be held responsible or liable if the passenger fails to take out adequate insurance cover.

Booking and payment

A non-refundable deposit of 20% of the total tour price is required in order to secure the reservation. Ngwe Safari reserve the right to cancel any reservation if the deposit is not received. The balance of the payment is due no later than six weeks prior to departure. If the final payment is not received timeously, travel documents can be delayed and may necessitate the use of a courier service, which will be for the passenger's account.

Prices

Prices are quoted at the ruling daily exchange rate. Until Ngwe Safari has received full payment, we reserve the right to change any variation to the passengers account. However, once full payment is received, the price of the land arrangements is guaranteed.

Cancellation

In the event of passengers cancelling their reservations, Ngwe Safari shall have the right to either claim the full deposit paid by such a passenger or claim damages suffered by the company. Ngwe Safari reserves the right to cancel any tour before departure. In which event the entire payment will be refunded without any further obligation on the part of the company. The maximum cancellation fees which may be imposed are as follows:

  • Deposit of 20% non-refundable
  • 8 weeks prior to departure: 25% of the tour price
  • 6 weeks prior to departure: 40% of the tour price
  • 4 weeks prior to departure: 100% of the tour price
  • 3 weeks prior to departure: 100% of the tour price

Late booking fees

A minimum late booking fee of R40.00 per booking will be charged in respect of bookings received within 30 days prior to travel date. This change is levied to cover communication expenses involved. An amendment fee of R25.00 per booking will be levied for any changes to the confirmed itinerary.

Unscheduled extensions

In the unlikely event of there being an unscheduled extension to the holiday, caused by flight delays, bad weather, strikes or any other cause which is beyond the control of the operator, it is understood that expenses relating to these unscheduled extensions (hotel accommodation etc) will be for the passenger's expense.

Responsibility

All tours are booked and arrangements are made, on the express condition that Ngwe Safari, their servants, employees, and agents (herein jointly referred to as "the carrier" shall, without in any way derogating from the force or effect of any limitation of liability and in addition thereto, not be liable for:

  • Any direct, indirect or consequential damages or loss howsoever caused and howsoever arising and whether arising during the course of or in consequence of or in any way connected with the services rendered by the carrier or not, whether such damages or loss result from breach of contract (whether total, fundamental or otherwise), delict, negligence or any other cause, without limitation, which might be suffered by me and/or any of my dependants and/or any other person accompanying me.
  • Any consequence of any omission, default or neglect on the part of the carrier and/or any incident involving any aircraft and/or motor vehicle and/or person and/or animal without limitation.
  • Any consequence of cancellation or postponement of any tour/safari or journey or any deviation or delay or failure to provide seating or facilities for carrying or storing luggage or for the failure secure or provide accommodation.

I indemnify the carrier against any claim of any nature whatsoever for any damages or loss Contemplated in these terms and conditions.

I am duly authorized to agree to these terms and conditions on behalf of my dependants and/or any other person accompanying me.

I agree that the governing law of all matters that may arise between the carrier and I is that of the Republic of South Africa.

Visas and vaccinations

The responsibility for the provision of current and valid passports visas, vaccinations, inoculations and the like, where required is that of the passenger alone.

Travel Documents

Documents (vouchers, itineraries etc) are only prepared on receipt of full and final payment and currency declarations.

Itinarary variations and transfers

While every effort is made to keep all published itineraries, we reserve the right to make changes for your convenience. In some cases, weather conditions can necessitate an alteration in the tour itinerary and this does not constitute any reason for a refund. No refunds for unused services will be considered.

Breakaways

While it is possible to break away from planned holiday itineraries, it is understood that such breakaways will be for the passenger's account and there will be no refund for unused services, accommodation, flights, transfers etc.

Legal jurisdiction

Ngwe Safari shall be entitled at its option to institute any legal proceedings arising out of or in connection with this contract in any Magistrates Court having jurisdiction terms of section 28 of the Magistrates Court Act no. 32/1944 as amended, notwithstanding that the amount in issue may exceed the limits of such jurisdiction.

Note: any reservation with Ngwe Safari is deemed to be an acceptance of these terms.
